Bridgton Developer Prevails Before Maine Law Court

In an appeal to the Maine Law Court, Jensen Baird attorney Mark Bower successfully defended a land use approval issued in favor of the law firm’s clients Saunders Mill, LLC, Main Eco Properties, LLC, and Nulty Street, LLC, who plan to develop a boutique hotel in downtown Bridgton. The opponents were abutters who had challenged the Planning Board’s approval on various grounds, including an argument that the future hotel’s stormwater management system would violate the Shoreland Zoning Ordinance.

Mark represented the hotel developer at extensive administrative proceedings before the Planning Board and Board of Appeals, as well as the Rule 80B appeals in Superior Court that resulted from two separate Planning Board decisions on the site plan application. In the consolidated appeal, the Law Court upheld (in a unanimous memorandum of decision) the Superior Court’s denial of the abutters’ appeal and affirmance of the Planning Board decisions, allowing the hotel development to move forward as planned.
